Usually a commission begins with a discussion between an interested client and me, the artist. Most clients already come with an idea for a piece of artwork and provide me with some visual material such as photographs, sketches or others. Once we agree on a preliminary project I will have to assess it and provide an estimate for its cost.
The figures to be assessed in such a calculation are designing, size, complexity of subject matter, approximate time needed to complete it and of course the materials requested or required.
If the client agrees to the estimate, a written agreement will be signed both by the client and myself. An example of the standard written agreement for small and medium works can be seen below. The mosaic will be created in my own studio by hand cutting and laying each tessera individually. The client is welcome to come and see his piece and its 'coming to life' at any point during the process.
Commission agreement between artist and client
This is an agreement between Iris Mueller (the artist) and _______________ (the client) for the creation of the art work. All rights and liabilities of either parties shall be governed by this agreement.
2. Description of the work
The work, to be created by the artist, shall be a rendering in mosaic of ______________ approximately _________ by _________ inches/cm (to be specified), unframed.
3. Obligations of the artist and the client
- the artist shall create the work and pay for all the necessary materials and supplies.
- the artist shall be responsible for the expenses of crating and shipping the work and, if
desired, for framing it.
4. Start and completion date
The artist shall undertake the creation of the work on or about ____________, and shall complete it on or about _______________ .
5. Fee and schedule of payments
The client shall pay to the artist the sum of $ _________ in total payment of the work.
The amount of $ _________ (1/3 of the total) shall be paid at the time this agreement is signed by both parties.
The second payment of $ _________ shall be paid when half the work has been completed and the balance of $ _________ (final 1/3 of total) shall be paid upon delivery of the work.
6. Acceptance of the work
If the client is not satisfied with the work half way through completion, the artist shall make reasonable changes in a good faith effort to satisfy the client's objections. If, following such changes, the client does not accept the work, the artist shall keep any portion of the fee already paid and shall retain ownership of the work.
7. Title of ownership
Title of ownership in the work shall pass from the artist to the client upon the client's full payment of the artist's fee.
